A member of the Osun State Home of Meeting, Hon. Kanmi Ajibola, has taken authorized motion towards the Nigerian Armed Forces over the current alleged coup plot aimed toward toppling President Bola Ahmed Tinubu’s administration and disrupting the nation’s democratic order.
Ajibola, who represents Oriade State Constituency, filed the swimsuit on the Federal Excessive Courtroom in Osogbo on Thursday, October 30, 2025, naming the Nigerian Military, Nigerian Air Pressure, Nigerian Navy, and the Legal professional-Normal of the Federation as defendants.
A authorized practitioner and former Chairman of the Nigerian Bar Affiliation (NBA), Ilesa Department, Ajibola is asking the courtroom to declare that no part of the Nigerian Structure or any legislation enacted by the Nationwide Meeting empowers the army to overthrow a democratically elected authorities.
‘Coup Has No Place in Nigerian Legislation’ — Ajibola
In a 23-paragraph affidavit connected to the originating summons, the lawmaker argued that the 1999 Structure, notably Part 217(2), clearly defines the constitutional capabilities of the armed forces. “There is no such thing as a provision within the Structure, the Armed Forces Act, or any legislation of the Nationwide Meeting granting the Nigerian army the ability to forcefully take over governance,” Ajibola acknowledged.
